BREAKING: We have just been informed by a reliable insider that the Administrative Committee of the Unified Patent Court has discreetly adopted the following amendment to Article 24(1) UPCA. The decision will become effective on 8 July 2025, coinciding with the implementation of the new Case Management System (CMS).

Pursuant to its competence under Article 24(2) of the Agreement on a Unified Patent Court (UPCA), the Administrative Committee has adopted the following amendment to Article 24(1) UPCA:

With effect from 8 July 2025, Article 24(1) shall be supplemented by the following point (f):

(f) Murphy’s Law

This amendment has been introduced in anticipation of the launch of the new CMS of the Unified Patent Court. The Committee considers the inclusion of Murphy’s Law a necessary clarification of the applicable sources of law during the transition period.

Footnote (leaked draft, Annex II to Rule 7 RoP):
In exceptional cases involving new IT systems, Murphy’s Law shall apply with precedence over national procedural law and the general principles of Union law, unless otherwise provided in a corrigendum.
